Terms & Conditions

1. Definitions: a) “Services” and “Works” means the engineering and associated services relating to the Customer’s equipment as set out in the proposal specified in our quotation or other agreed documents or discussions between us. b) “We”, “us” and “our” mean Mill Lane Electrical Services providing services to you. c) “You” and “Your” and “Customer” and “Client” mean the person or company to which we are providing services. d) “Customer’s Equipment” means the material or equipment belonging to you, or which you request us to provide services.

2. Installation Work: a) All electrical installation work will comply with BS7671:2018 and any amendments in force at the time of the works. b) All electrical installation work will comply with applicable Building Regulations in force at the time of the works. c) Where work is to extend or modify existing circuits, costs quoted assume that the existing installation is in adequate condition and complies with minimum current regulations. Any works found required to bring the necessary parts of the existing installation up to standard will be at additional cost. d) Unless stated otherwise, all cables will be concealed by chasing into the building fabric or concealed in building voids, under floors, etc. Where impracticable, cabling will be neatly surface run, either clipping direct or housed in trunking / conduit. e) Where carpet or flooring coverings may require lifting to allow concealed installation work, with best endeavours being made to avoid damaging them and to refit them to an acceptable standard. However, consideration of employing a specialist fitter may be prudent, at your cost to effect a fully satisfactory reinstatement. f) Where agreed beforehand, chases to walls, etc will be re-filled to 2mm below plaster finish depth, however final finishing of skim coat plaster and final decoration is excluded. g) Accessing of underground locations – If the work requires us to access any underground locations, you will need to tell us the exact location of any underground electrical services on the site, and also the location of underground gas, sewer, pumping, water, oil pipes and cable services. Whilst all due care is taken, you will indemnify us against any loss or damage that we cause or suffer, as a result of accessing the underground locations. h) All endeavours will be made to undertake installation work to a clean standard, using dustsheets and vacuum cleaning equipment as necessary. i) The contract outlines the expected duration of the installation work. Completion of the services is an estimate only and Mill Lane Electrical Services shall endeavour to complete the services at a time or times required by the Customer, but failure to do so shall not confer any right of cancellation, termination or refusal of delivery on the Customer’s part or render Mill Lane Electrical Services liable for any loss or damages directly or indirectly sustained by the Customer as a result thereof. j) Whilst undertaking the installation work at the property, the client is required to provide water and power free of charge

3. Exclusions: a) Clearing and / or moving of furniture and other items blocking access to work areas are not included. b) Except where detailed, builders work (creating of holes larger than 50mm diameter, creating of support structures, etc) are not included, except as outlined in 1d, e and f, g above. c) Re-decoration and final making good is excluded from quoted costs, unless specifically detailed as included. d) Removal from site and disposal of rubble, fittings, wiring, materials, general waste and packaging is not included.

4. Extras and Variations: All extras and variations must be agreed in writing prior to commencement.

5. Any Other Services: a) All endeavours will be made to undertake any other work to a clean standard, using dustsheets and vacuum cleaning equipment as necessary. b) Any date or time quoted for delivery and completion of the services is an estimate only and Mill Lane Electrical Services shall endeavour to complete the services at a time or times required by the Customer, but failure to do so shall not confer any right of cancellation, termination or refusal of delivery on the Customer’s part or render Mill Lane Electrical Services liable for any loss or damages directly or indirectly sustained by the Customer as a result thereof.

6. Pricing:a) The costs quoted assume continuous and unhindered access to the site by prior arrangement with you. b) Our quotation provides an indication to you of the services/items on which you may place an order, but no order from you as a result of a quotation (or otherwise) shall be binding upon us unless and until it is accepted or confirmed by us. c) A quotation is made on the assumption that the work requested is reasonably capable of being carried out. If on inspection this is found in our opinion not to be the case, we will advise you to this effect as soon as reasonably practicable, and may offer you a reconditioned or new substitute on terms to be agreed. d) If you give a general instruction for repairs without specifying the particular service or replacement parts, we will be entitled to carry out such repairs, or modifications or service as in our opinion are necessary to put the Customer’s equipment in good working order, and to make an appropriate charge for the work and parts provided. e) Unless stated otherwise, the costs quoted assume standard working hours between the hours of 09:00 hrs - 17:00 hrs Monday to Friday inclusive (these times may need to be extended to complete the works on time). Work required outside these hours may attract out of hours premium rates. f) Any additional work not covered in our quoted costs will attract additional time charge rate of £35.00 per hour plus materials cost. g) All figures quoted are valid for a date of 30 days from the date of the estimate or quotation.

7. Designs, Drawings and Specifications: a) You shall be responsible for the accuracy of any designs, specifications and other data, which you or your employees or agents supply to us, which we use in connection with the services, even if we examine, inspect or comment upon them. You will hold us harmless against any liability to a third party which we may incur as a result of carrying out the services in accordance with your instructions or your designs, drawings, specifications or other data.

8. Deviations from Building Regulations and BS7671: b) All work where applicable, will be executed fully in compliance with applicable Building Regulations and BS7671 in force at the time of the work, particularly in respect of work in dwellings to allow the legal Part P obligations to be met. Where a Client requires deviation from such regulations, a written instruction and record will be required.

9. Risk and Title of Goods and Property: a) The risk in all goods supplied shall pass to the Client upon delivery. b) The customer shall examine the products immediately after delivery and Mill Lane Electrical Services shall not be liable for any misdelivery, shortage, defect or damage unless Mill Lane Electrical Services receives details in writing within 7 days of the date of delivery of the products. c) All goods supplied shall remain property of Mill Lane Electrical Services until all sums due have been paid in full. d) The client is responsible for ensuring that the property is insured for the duration of all works.

10. Warrantee: a) Mill Lane Electrical Services warrants its installation work to be defect free for a period of 5 years from the invoice date and any parts supplied for duration of the goods./parts manufacturer’s warranty. Such cover does not extend to goods/parts not supplied by Mill Lane Electrical Services, physical damage to products including any damage caused by liquid, rust or corrosion, or any instance where the original installation has been altered or tampered with subsequently by third parties. b) In respect of all claims, Mill Lane Electrical Services shall not be liable to compensate the Customer for any delay in either replacing or remedying the workmanship or in properly assessing the Customer’s claim. c) If Mill Lane Electrical Services must make an inspection outside of our premises, a charge may be made to the Customer for all reasonable costs incurred including labour, travelling and other out-of-pocket expenses incurred if the fault or defect is deemed to be outside this warranty. d) If Mill Lane Electrical Services replaces defective goods, ownership in those defective goods transfers wholly and unconditionally to Mill Lane Electrical Services. e) Where the Customer seeks to have defective goods replaced, Mill Lane Electrical Services must have received notice from the Customer within the goods manufacturer’s warranty period. f) Customers returning defective goods/parts - If a claim is made by a Customer and Mill Lane Electrical Services, after assessing the item, deem this to be out of warranty, Mill Lane Electrical Services will make reasonable attempts to contact the Customer to arrange for the items to be returned. If, after 30 days, the Customer has not made arrangements to have the goods returned, Mill Lane Electrical Services may dispose of the goods at the Customer’s expense.

11. Payment: a) Unless agreed in writing payment in full must be made on completion of the specified works to Mill Lane Electrical Services. b) Stage payments will be requested by prior arrangement where planned works take longer than 7 days. We reserve the right to request from you stage payments in the instance where works take longer than 7 days. c) Unless otherwise agreed with you by us, we will issue an invoice for the full amount due on completion of the services. Invoices will be due for payment no later than 7 days from the date of the invoice. d) All payments will be in pounds sterling. e) We will contact clients via email and telephone to remind them of such payments if they are not received when due. f) If accounts are not settled or Mill Lane Electrical Services have not been contacted regarding the delay, we may then pass such cases to the Small Claims Court to pursue payment, non-payment can result in county court judgments (ccj’s) being added to the clients credit rating. g) Following consistent non-payment of an invoice our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons. h) The Customer will not be relieved of any obligation to accept or pay for products by reason of any delay in delivery or strike, lockout, unavailability of raw materials, accidents to machinery, breakdowns, shortages of supplies or labour, fires, floods, storm or tempest, transport delays, acts of God, restrictions or intervention imposed by any laws, regulations, Governments or agency’s thereof and any other cause beyond the control of Mill Lane Electrical Services or any other cause whatsoever. i) Any payment made by or on behalf of a Customer which is later voided by the application of any Statutory Provision shall be deemed not to discharge the Customer’s indebtedness and in such an event the parties are to be restored to rights which each respectively would have had if the payment had not been made.

12. Force majeure: a) Mill Lane Electrical Services will not be liable to you for any failure to perform our obligations under this agreement, where that failure results from any cause outside our reasonable control, including, but not limited to, War, Strikes, lockouts, industrial disputes or unrest, unavailability of raw materials, accidents to machinery, breakdowns, shortages of supplies or labour, transport delays, natural occurrences, acts of God, theft, vandalism, riots, civil commotions, accidents of any kind, disruption of power supplies, the action of third parties, restriction imposed by any laws/regulations or industrial action.

13. Dispute Resolution: a) In the event of a dispute, mediation is to be the preferred method of resolution. b) Payment for the full contract amount to be paid within 7 working days of completion regardless of any unresolved disputes, otherwise subject to 8%APR until paid in full. c) Where we use sub-contractors to complete tasks out of our description we do so in good faith. However, any problems that require a resolution will need to be done so with them directly. We do not guarantee the work of others. d) In the unlikely event of a complaint, any remedial works will be undertaken by Mill Lane Electrical Services or selected sub-contractors. We will not pay for others to complete such tasks.

14. Photographs: a) We reserve the right to take photographs and video of completed works for our records and for use in our portfolio unless requested in writing prior to commencement not to do so.

15. Termination of Contract: a) We may bring this contract to an end if you fail to comply with your obligations under this contract, within seven days of having been notified by us of the relevant failure. We may also bring this contract to an end immediately if you are the subject of a petition for a bankruptcy order, or you become insolvent, or enter into any composition, scheme or arrangement with your creditors. If you are a corporation or other legal person, we may bring this contract to an end immediately if a receiver (including an administrative receiver) is appointed over any of your assets, or an application is made to appoint an administrator for you. If you are in partnership, we may bring this contract to an end immediately if the partnership is dissolved. We may also terminate this contract if any proceedings relating to your insolvency are commenced in any country. If this agreement ends for any reason, we will be entitled to remove all of our equipment from your premises or from site. You will remain liable to us for any sums which you have not paid, for all work done up to the date of termination and for any other breaches of this contract.

16. Customer Acknowledgements: a) It is the sole responsibility of the Customer to check and confirm the order with Mill Lane Electrical Services prior to signing the Quote. Mill Lane Electrical Services will not be held liable for incorrect orders. b)

17. Law: a) This agreement is governed by English Law.

18. Privacy Policya) What information do I collect? I collect information from you when you, request a quote, telephone me, email me. b) What do I use your information for? Any of the information collected from you may be used in one of the following ways: The email address you provide may be used to send you information, send you invoices, send you receipts, send you work certificates, and respond to enquiries, and/or other requests or questions. c) Do I disclose any information to outside parties? I do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. 19. GDPR Policy a) This policy is intended to demonstrate how Mill Lane Electrical Services manages and processes personal identifiable information received about you to comply with the requirements of the General Data Protection Regulation (GDPR).. b) Who is collecting your information? Mill Lane Electrical Services (Ian Frost – Data Protection Officer (DPO) & Electrician, Sole Trader). c) What information do we collect? The most data Mill Lane Electrical Services will collect from you includes: · your name,· company name,· email address,· telephone number· postal address. d) How is it collected? I may collect data from you via email address, or over the telephone, email or in person when discussing work you that you would consider Mill Lane Electrical Services to undertake. e) Why is it being collected? So that I know who you are and am able to respond to you. f) How will it be used? To communicate with you regarding current & relevant projects to you or your business. If you become a client of Mill Lane Electrical Services then your data will be retained for no longer than is necessary for the purposes it was collected. The length of time we retain your information for is determined as required by law for HMRC and insurance and other trade bodies. g) Who will it be shared with? Nobody. I do not disclose or sell your personal data to any other companies or individuals. h) How do we keep your information safe? We take reasonable steps to protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data. i) Your Rights Under UK data protection law, you have certain rights over the personal information that we hold about you.
